ZBA2014-14 Application variance from regulation 7.07.05 (Separate Family Quarters) to build in-law apartment in basement at 234 Village Hill Road (Map 47 Lot 14 Zone R80) Owner/Applicant: Douglas Strickland (Received November 13, 2014 Public Hearing November 13, 2014) Decision within 65 days after close of P.H.
Josh Strickland the owners’ son was present to speak about the application. He said that they would like to put an in-law apartment in basement. The issue is that there is no common area shared between the basement and upstairs living area of the house. The only access is the common area in the garage. The house was not built with an interior stair well. There will be two accesses to the basement a stair way and an egress window per the building code. The hardship being that the house was not built with any interior access to the basement. R. Maloney asked if anyone present wanted to speak either for or against the application. No one present spoke.

ZBA2014-15 Application variance from regulation section 8 (Table 8.2 Schedule of Dimensional Requirements) for a 20’ side yard variance for a storage shed/garage at 66 Latham Road (Map 9 Lot 17 Zone R80) Owner/Applicant: Felipe Silva (Received November 13, 2014 Public Hearing November 13, 2014 Decision within 65 days after close of P.H.
Felipe Silva was present to speak about his application. He said that he was having a new septic system installed. In the future he would like to put on an addition and have a shed/garage. The location of the shed/garage will need a variance; it will be within 5 feet of the property line. The hardship is the property is nonconforming. The house was built in the 1950, with the addition of the new septic and size of the lot the only location would be on the side line.
M. Masinda asked if anyone wanted to speak either for or against the application. Rick Soucy an abutting property owner spoke in favor of the application.

ZBA2014-16 Application variance from section 4.05 (accessary building in front yard) at 143 Tolland Turnpike (Map 29 Lot 23 Zone R80) Owner/Applicant: Michael Garneau (Received November 13, 2014 Public Hearing November 13, 2014) Decision within 65 days after close of P.H.
Michael Garneau was present to speak about his application. He said the front of the house faces the pond he has a shared driveway coming off of Tolland Turnpike. The regulations consider the driveway coming off of Tolland Turnpike to the garage, the front of the house. In the back of the house is the septic system and leaching fields a large pine tree and ledge. The only area for the shed would be too located in the front of the house. M. Masinda asked if anyone wanted to speak either for or against the application. No one present spoke.

R. Maloney motion to approve application as presented. ZBA2014-14 variance from regulation 7.07.05 from the section that states only access shall be through the living spaces of the principal dwelling. The house shall be owner occupied and the in-law apartment may only be used by relatives (not a rental) and maybe be access through the garage. John Prusak seconded the motion.
The Board Members discussed the regulations and the intent of the regulations. If approved the variance needs to be very specific.
All voted in favor.

J. Prusak motion to approve the request for a 20’ side yard variance. Motion seconded by R. Maloney. The Board Members discussed that the hardship is a non-conforming lot.
All voted in favor.
ZBA2014-16 Application variance from section 4.05 (accessary building in front yard) at 143 Tolland Turnpike (Map 29 Lot 23 Zone R80) Owner/Applicant: Michael Garneau (Received November 13, 2014 Public Hearing November 13, 2014) Decision within 65 days after close of P.H.
W. Bland motion to approve the application for a front yard variance. R. Maloney seconded the motion. The Board Members discussed the uniqueness of the property the location of the septic system and leaching fields. A. Poole said that the accessory building will be used for storage and is not being used for parking vehicle. The property is flat and has open areas in the back and side where the building could be located. A. Poole said we are looking at the variance based on the hardship. The building could be put in other areas and conform to the regulations.
J. Prusak voted in favor. Opposed were W. Bland, R. Maloney, M. Masinda and A. Poole. Motion was denied.
W. Bland motioned to approve the minutes with correction of the September 11, 2014 meeting. P. Prusak seconded the motion. All voted in favor.
M. Masinda motion to adjourn the meeting. R. Maloney seconded the motion. All voted in favor.
